Avidyne Privacy Policy


Information Collection and Use:

Avidyne will collect and use customer identifiable information for billing purposes, to provide and change service, to anticipate and resolve problems with your service.

When you access the Internet, the computers that host Web sites you visit (Web servers) automatically receive some anonymous information. This "usage data" may include a record of which pages a Web browser has visited. Avidyne's site logs generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff to provide better services to the customers.

While using myAvidyne.com, cookies may be stored on your computer. A cookie is a small data file that is sent to your browser from a Web server and stored on your computer's hard drive. These files identify your browser and save information such as passwords so that Web sites can recognize you, provide easier site navigation and access to forms. Disabling cookies on your web browser will cause the web site to become unusable.

Except as identified in this policy statement, Avidyne does not supply customer identifiable information to advertising companies or to individual advertisers or other third parties. If you go to another Web site, including an advertiser's Web site, and request or supply information, be aware that you may be authorizing another company, including an advertising company, to use the information you supply. Avidyne is not responsible for the privacy practices or content of these sites.

Disclosure: Avidyne will not sell, trade, or disclose to third parties any customer identifiable information derived from the registration for or use of an Avidyne product or services without the consent of the customer except as follows. Avidyne may release customer identifiable information to appropriate governmental authorities under the following circumstances:

• Where release is required by law (for example, a subpoena) or regulation, or is requested by a government agency conducting investigations or proceedings;
• Where our records indicate a company or individual may be engaged in fraudulent activity or other deceptive practices that a governmental agency should be made aware of; or
• Where your communication suggests possible harm to others.
When Avidyne uses other agents, contractors or companies to perform services on its behalf, Avidyne will ensure that the company protects your customer identifiable information consistent with this Policy.

Customer Choice: A customer may choose not to receive direct marketing communications from Avidyne in connection with Avidyne products or services. Upon such choice, Avidyne (a) will not contact that customer directly with marketing messages about Avidyne products or services, and (b) will not use customer identifiable information obtained from that customer's registration for or use of an online service to contact that customer with marketing messages about any Avidyne products or services.

Security: Avidyne has implemented security features and strict policy guidelines to safeguard the privacy of your customer identifiable information from unauthorized access or improper use.

E-mail Contents: The company will not read or disclose to third parties private e-mail communications that are transmitted using Avidyne services except as required to operate the service or as otherwise authorized by law.

Improper Conduct: Avidyne may also use customer identifiable information to investigate and help prevent potentially unlawful activity or activity that threatens the network or otherwise violates the customer agreement for that service.

Account Information: Avidyne honors requests from customers to review all customer identifiable information maintained in reasonably retrievable form, and will correct any such information which may be inaccurate. Customers may verify that appropriate corrections have been made.

Changes in Practices: Avidyne will keep this Policy current. This Policy was last changed on November 27, 2002. If Avidyne makes changes to any terms or conditions of this Privacy Policy, these changes will be posted on www.myAvidyne.com in a timely manner.

Disclaimer: While Avidyne endeavors to protect personal information about its customers, Avidyne cannot ensure or warrant the security of any information you transmit to us. Transmitting personal information is done at the consumer's own risk.

Privacy Protections for Children Using the Internet: Avidyne recognizes that children, including young teens, may not be able to make informed choices about personal information requested online.
Avidyne does not target children or teenagers (younger than eighteen years of age) for collection of information online. Avidyne does not solicit or collect customer identifiable information targeted at children and teenagers under eighteen.

Avidyne encourages parents to take an active role to protect the privacy and security of their children and to prevent the inappropriate use of information about their children.
Avidyne complies with all Federal laws and regulations, including the Children's Online Privacy Protection Act, which requires the consent of a parent or guardian for the collection of personally identifiable information from children under 13 without the consent of a parent or guardian.
